A bankruptcy workout affects creditors and debtors. Our law firm has represented clients in both situations.
Advising and representing debtors: As part of the process, our attorneys will analyze the debtor's financial condition and recommend either an out-of-court settlement or some type of court proceeding such as a state assignment for the benefit of creditors, a trust security agreement or federal bankruptcy proceeding (Chapter 7, Chapter 11, or Chapter 13).
Often all that will be required is negotiating a forbearance agreement with secured creditors and similar arrangements with unsecured creditors and working through those agreements with the debtor and creditor(s).
Advising and representing creditors: Our lawyers represent secured creditors and unsecured creditors and participate in negotiations and various types of court and out-of-court meetings and proceedings. Our work for your business can include negotiation and drafting of forbearance agreements, commencing and concluding foreclosures of both real and personal property, and other actions including litigation to collect debts due the client.
