Jacqueline A. Kelly concentrates her practice on multiemployer fringe benefit fund representation, with an emphasis on ERISA and IRC compliance, plan documentation, and counseling trustees. Her focus also includes issues of fiduciary responsibility, benefit claims, prohibited transactions, agreements with third party vendors, withdrawal liability, and merger issues. She works closely with administrators in the day to day operations of multiemployer fringe benefit funds. Ms. Kelly also has significant involvement in complex ERISA litigation and provides counsel to clients in other areas of federal and state employment and benefit laws.
Ms. Kelly is a former Visiting Associate Professor of Law at the Detroit College of Law and former Legal Research and Writing Instructor at the University of Detroit Mercy School of Law. She graduated from Kalamazoo College in 1985, where she received numerous academic awards, and from the University of Detroit School of Law, magna cum laude, in 1988. She is published in the International Foundation of Employee Benefits Journal, Defense Law Journal, and University of Detroit Law Review, and has lectured on the Pension Protection Act of 2006, employment discrimination and benefits, and has been a speaker at the Annual Enrolled Actuaries Annual Meeting.
Ms. Kelly is admitted to practice in the Michigan and New York trial and appellate courts, and multiple U.S. District Courts and U.S. Circuit Courts of Appeals. She is a member of the International Foundation of Employee Benefit Plans, and the Michigan, New York, and American Bar Associations. She is a Shareholder of Sullivan, Ward, Asher & Patton, P.C.
